TenantBinder Electronic Records and Signatures Disclosure and Consent

TenantBinder (“we”, “us”) provides an electronic platform for preparing, sending, reviewing and signing residential tenancy documents. Under the federal Electronic Signatures in Global and National Commerce Act (E-SIGN, 15 U.S.C. §7001 et seq.) and applicable law, your consent is required before records may be delivered to you, and your signature accepted, in electronic form. Please read this disclosure and give or withhold your consent below.

1. What you consent to

By accepting, you agree to conduct this signing entirely electronically: to receive every record related to it — the document presented for signature, this disclosure, notices, and the completed document with its signing certificate — in electronic form through the TenantBinder application or by email to the address verified during this ceremony, and to sign the document electronically. Electronic records and signatures have the same legal effect as paper ones. Your consent covers this signing only, not any future transaction.

2. Your documents are encrypted with keys we do not hold

Documents on TenantBinder are end-to-end encrypted. The encryption keys are stored on your devices and the devices of the other parties — we do not hold them and cannot read, recover, or reproduce your documents without them. Keep the TenantBinder application installed on at least one of your devices and retain your own copies of completed documents; if all key-holding devices are lost, we cannot provide the documents to you or anyone else.

3. Paper copies

Because your documents are encrypted with keys we do not hold, we cannot produce a paper copy from our systems. To receive one, download the electronic document from your TenantBinder application and send it to [email protected]; we will print it and mail it by regular post to the postal address you provide. This is a paid service — the fee depends on the cost of delivery and is quoted before we send. Requesting a paper copy does not by itself withdraw your consent to transact electronically.

4. Withdrawing consent

Your consent applies to this document only, so there is nothing to withdraw for future transactions — each signing asks for its own consent. Before you complete your signature, you may withdraw this consent by closing the signing session and contacting the other party or [email protected]; withdrawal takes effect once we have a reasonable period to act on it. Once your signature is complete, this consent can no longer be withdrawn: records already delivered and signatures already made remain valid, and the completed document is not affected.

5. Consequences of withdrawing consent

If you withdraw consent, this signing cannot be completed electronically. The party who sent the document to you may offer to sign on paper or may be unable to proceed. There is no penalty for withdrawing consent other than the inability to use the electronic signing process for this document.

6. Hardware and software you need

To access and retain electronic records you need: a current version of a web browser or the TenantBinder mobile application; a device able to display PDF documents; a valid email address and a mobile telephone able to receive SMS messages, both of which are verified during this ceremony as your identity credentials; the encryption keys held by your TenantBinder application (see section 2); and local storage or a printer to retain your own copy of the records. If our requirements change in a way that materially raises the risk that you could not access or retain records, we will notify you.

7. Keeping your contact information current

You are responsible for keeping the email address and telephone number used for this signing accurate and current. Notify the other party if they change before the signing is complete.

8. Your acknowledgment and consent

By accepting, you confirm that you have read this disclosure; that you can access records in the electronic form described above; that you consent to conduct this signing electronically — to receive records electronically and to sign this document electronically; and that you have not withdrawn that consent.
